郑州公交卡收30元押金被指不合理 律师起诉获立案-搜狐新闻  央广网郑州2月17日消息(河南台记者杨扬 陈弓)据中国之声《新闻纵横》报道,每天,成千上万的上班族怀揣一张薄薄的公交卡四处奔波。公交卡里不仅有个人自愿存储的交通费,还有一笔强制交纳的10元至30元不等的押金。这笔看似不起眼的“小钱”,但是汇聚起来数目惊人。据住建部IC卡应用服务中心去年统计的数据显示,全国有约4亿多张正在使用的城市公交IC卡,仅北京、上海、广州三个城市的押金总额就超过了10亿元。   那么,这笔数额巨大的押金款项收取的是否合理,又流向何处呢?郑州的一名律师对“绿城通”卡收取的30元押金提出了质疑,认为这笔钱收的不合法、不合理,于是他把郑州城市一卡通有限责任公司、郑州轨道交通有限公司两家单位告上法庭,要求判定此举违法并退还多收取的押金,目前郑州市二七区法院已经受理此案。   因绿城通押金一事发起诉讼的是河南国基律师事务所律师张伟,他说自己前段时间乘坐地铁时,为了购票方便就在地铁站内申请办理“绿城通”卡,车站工作人员说需要收取30元持卡押金,卡片不记名、不挂失、不计息,只有持卡人申请退卡时,才能将30元押金退还,他觉得这种行为不合情理。   张伟提出质疑,卡的成本也就在5-10块钱之间,押金就是保证这个卡不会受到损失、丢失,成本不会受到损失,为什么向老百姓收30块钱的费用呢?   张伟还说,因为绿城通卡不记名、不挂失、不计息,如果别人捡到这张卡,也能兑换押金,损失的是消费者本人,从某种角度讲,发卡公司收取了押金,却没有保障消费者的任何权利,反而加重的了消费者的负担。所以张伟说,正是这次“被迫”进行的消费行为,让他感到合法权益受到了侵犯,决定起诉维权。   张伟认为,成千上万用户的押金将会积累起很大一笔数字,他觉得有必要作为消费者的一员站出来,代表广大的消费者提出这个诉讼,要求法院对这种行为的公正性,公平性、合法性进行审查,以促使公交发卡公司公平合理的制定押金的数额。   本月4号,张伟向郑州市二七区人民法院递交了民事起诉状,要求判决郑州城市一卡通有限责任公司收取30元押金的行为违法,并退还押金25元、公开赔礼道歉;要求郑州轨道交通有限公司对第一被告的侵权行为承担连带责任。郑州市二七区人民法院工作人员表示,目前这起案件已经立案,但是具体开庭日期还没有确定。   具体案件审理还需要等待,那这起案件的另外两方当事人又是如何回应的呢?记者先联系了郑州市轨道交通有限公司,工作人员说:绿城通现在有一个一卡通公司,他们在负责,我们这边没有接到这方面的通知。   随后记者又联系到郑州城市一卡通有限责任公司新闻发言人刘广乐,他表示绿城通押金的事儿比较复杂,需要等待法院的判决。   在2013年年底郑州市刚开始办理绿城通卡的时候,押金一事就成为市民关注的焦点,当时郑州城市一卡通有限责任公司也曾召开发布会,对绿城通收取30元押金一事做出解释。刘广乐解释,“绿城通卡每个市民拿到手里只是一个卡片,是一个载体,后台有相关的软件、硬件,以及各个运营系统的支撑,为了它的运营维护,我们需要收取30元的押金。有了押金的保障,让市民尽到保护义务和注意义务。30元的押金是沿袭公交原有的收费标准”。   对于押金收取金额是否合理、押金究竟用在哪儿了,有疑问的不仅仅是这次提起诉讼的律师张伟,很多市民也充满了疑惑。   有市民表示,“我觉得公交卡、地铁卡收押金这个事儿本事倒没有什么不合理的,但是我觉得这个30块钱可能有点多了,因为卡的成本如何核算的话,肯定是不到这个价位,像我其实就丢了两三张公交卡了,这样算来我基本上损失了100块钱,这100块钱也没地儿说理”。“如果一个人收30,整个郑州市这么多人,这么多钱到底去哪儿了,这个是我想提出的一个疑问”。   其实,不止在郑州,公交卡、地铁卡数额巨大的押金款项到底由谁在管理,收益情况如何,在全国其他地方也受到过质疑。2012年前后,北京、福州、广州、厦门、南京等十几个城市的市民相继向当地政府相关部门申请公开或提起诉讼,但至今,公交卡、地铁卡押金依然是笔“糊涂账”。相关的主题文章:
